Terms and Conditions

All use of DD&A Architect Panelist website (the "Panel Portal") is subject to the terms and conditions set forth below. Any use of the Panel Portal constitutes your agreement to abide by these Terms and Conditions. If you DISAGREE with any of the terms, conditions and provisions set forth in these Terms and Conditions, please do not use this site. DD&A reserves the right to terminate or amend these Terms and Conditions at any time without prior notification. In the event of any amendments to these Terms and Conditions, changes will be posted on the Panel Portal at: Terms and Conditions. 

Membership

Membership as an DD&A Architect Panelist is open to individuals who are 18 years of age or older and a resident of United States of America. Qualified members are eligible for one account only. While multiple people who are employed from the same company can join, each person must have a unique email address to participate in the DD&A Architect Panel.

Site Usage

To become a member, you agree to provide valid information when you register. You agree not to make false statements or provide misleading information in order to gain access to this site or to obtain membership. DD&A reserves the right to terminate members who provide duplicate or false information during registration.

All information provided by DD&A and its affiliates is owned by or licensed to DD&A and its affiliates (the "Dodge Data & Analytics Information"). DD&A and its licensors retain all proprietary rights to the Dodge Data & Analytics Information and you shall honor all reasonable requests by DD&A to protect its proprietary rights to the Dodge Data & Analytics Information.  Except where expressly permitted, you agree not to e-mail, download, copy, transmit, rent, lend, license, lease, sell or modify any materials from Panel Portal, nor modify nor remove any proprietary notices contained therein, nor create derivative works based on materials therefrom.

Users entering materials on the Panel Portal are responsible for the content of that material; however, you may not input or distribute any material through the Panel Portal which is promotional in nature, including solicitations for funds or business, without the prior written authorization of DD&A. DD&A nor its affiliates are responsible for the content of any messages or information posted by you or any other users, nor for the content of information of third-parties on the Internet, even if accessed through the Panel Portal. Notwithstanding the foregoing, DD&A retains the right, which it may or may not exercise, in its sole discretion, to review, edit or delete from the service any third-party material which DD&A deems to be illegal, offensive or otherwise inappropriate. DD&A has a perpetual, non-exclusive right to use all material and information entered into the Panel Portal by users in any of DD&A’s or DD&A’s affiliates’ print or electronic publications, services or sites (including, without limitation, the Panel Portal).

Confidentiality

Except where required by law, the contents of any information associated with surveys conducted by DD&A via the Panel Portal shall be kept confidential by you and never shared with a third party.

Account and Security

It is your responsibility to keep your login and password information strictly confidential. In the event that you lose your login or password or you discover that a third party has accessed your login or password, you agree promptly notify DD&A. DD&A will not be liable for any losses or damages resulting from failure to comply with this policy.

Personal Information

DD&A reserves the right to verify information submitted on the Panel Portal. This includes information submitted during your registration. It is your responsibility to make sure that your personal information is updated regularly. DD&A is committed to protecting your privacy. Termination/Suspension

DD&A reserves the right to terminate membership in the DD&A Architect Panel without cause or notice at any time and without further liability to you whatsoever due to violations or breaches of any of these Terms and Conditions. Circumstances which will result in membership termination/suspension include but are not limited to (a) violations of this Terms and Conditions or other membership guidelines; (b) submitting fraudulent or misleading information in surveys or during member registration; (c) creation of multiple accounts by same member; (d) responding to surveys that were not intended for the member; (e) tampering with another user’s login or personal information; (f) using software programs to complete surveys or submit multiple registrations; (g) taking advantage of technical glitches to redeem incentives that were not earned.

Limitation of Liability

THE DODGE DATA & ANALYTICS AND ITS LICENSORS MAKE NO GUARANTEES OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE AS TO THE DODGE DATA & ANALYTICS INFORMATION OR THE PANEL PORTAL, OR ANY WARRANTIES AS TO THE ACCURACY, COMPLETENESS, CURRENTNESS, OR RESULTS TO BE OBTAINED FROM USING THE DODGE DATA & ANALYTICS INFORMATION OR THE PANEL PORTAL, OR AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS. Neither DD&A, its affiliates and/or licensors shall be liable to any user or anyone else for any inaccuracy, error or omission, regardless of cause, in The Dodge Data & Analytics Information and/or the Panel Portal, nor shall DD&A be liable for any direct, indirect, punitive, consequential or incidental damages, or damages for loss of profits, loss of revenue that result from, or arise out of the use of The Dodge Data & Analytics Information contained or received through use of Panel Portal, or any services or products received through the Panel Portal, or any website accessed from the Panel Portal.

Indemnification

You agree to take all necessary action to defend, indemnify and hold DD&A harmless, its officers, employees, licensors and other affiliated companies against all costs, expenses and damages incurred in connection with any claim presented by a third party against DD&A arising from a breach by you of any of these Terms and Conditions.

Miscellaneous

This agreement constitutes the entire agreement between the parties related to the subject matter. If any provision of this agreement is deemed unlawful or prohibited by law or held to be unenforceable, the remaining provisions shall not be affected, and this agreement shall continue and be enforced to its full extent.
